Prudent Insurance Brokers Pvt Limited (“Prudent”) is committed to safeguarding the privacy and
confidentiality and security of your Personal Data or Information.
Prudent is an Insurance Broker engaged by your organisation / employer to provide insurance broking,
risk management and insurance policy administration services as the case may be.
Prudent is a processor of the consented information (including personal information) it receives from its client / their employees who is a data fiduciary and shares the collected data with the Insurer and third party administrator, also a data fiduciary for the purpose of providing their respective services.
As part of the insurance policy administration, Prudent has extended this website / portal as well as a Whatsapp chatbot (either being referred to as “Portal”)to facilitate the enrolment process and to provide a self service portal for any update that you may seek from time to time.
In the process of you using any Portal or availing of the existing or future services or facility provided by the Portal, you may be required to furnish information, including Personal information and/or Sensitive Personal Information and/or any other information that is of a confidential nature. You are urged to keep the information current to ensure that the services and facilities remain relevant and enable us to reach you and provide you with the accurate details.
By sharing your details on any Portal, you confirm that you have understood the purpose of sharing your information and provide your explicit consent for such processing by Prudent for the
contracted services.
In case you are sharing details of minors (below the age of 18) to be covered under the services provided by Prudent, you hereby accept that you are the guardian and have the legal authority to provide consent on behalf of the minor.
In case you are sharing details of any incapacitated individuals/dependents, you hereby accept that you have a power of attorney to sign/provide consent on behalf of the incapacitated
individual/dependent along with a doctor’s note stating that the individual/ dependent was
medically/mentally fit to enter into a contract as of the date of the execution of the power of attorney.
Definitions
- “Prudent” or “Company” or “Us” or “We”- refers to Prudent Insurance Brokers Pvt Limited.
- “Insurance Policy” means general insurance policy issued by the Insurer chosen by your
organisation.
- “Privacy Policy” means this Policy.
- “You” or “User(s) or Data Principal” means the person(s) visiting/accessing the Portal in any capacity and sharing/submitting details on th Portal and include all individuals whose data is shared/submitted on the Portal.
- “Portal” – refers to www.prudentplus.in website and additional Portals/Micro/Mini/Mobile
sites, whatsapp chatbot and any other means of communication and servicing that is created and that link to the main back-end to create a distributed presence to fulfil the needs & functional requirements of all segments of customers.
- “Services” – all services made available by Prudent through any Portal as permitted under
applicable law.
- “Personal Data or Information" means any information that relates to a natural person which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying or relating itself to such person and/or the property(s)/profession of a person and/or any other personal information of such person.
- “Sensitive Personal Data or Information”: Sensitive Personal Data or Information of a person means such personal Data or information which consists of information relating to:
- (i) password;
- (ii) financial information such as Bank account or credit card or debit card or other
payment instrument details;
- (iii) physical, physiological and mental health condition;
- (iv) sexual history or orientation;
- (v) medical records and history as to any type of ailments [including HIV/AIDS] and health status of insured and his/her family members;
- (vi) Biometric information of person or employee;
- (vii) any detail relating to the above clauses as provided to body corporate for providing service; and
- (viii) any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise:
Provided that any information that is freely and legally available or accessible in public domain or furnished under any statutory provisions for the time being in force shall not be regarded as sensitive Personal Data or Information for the purposes of this Privacy Policy.
- "Data Fiduciary" - means any person who alone or in conjunction with other persons determines the purpose and means of processing of personal data; and refers to our engaging client (your employer in most cases) and the Insurer.
- "Data Processor" - means any person who processes personal data on behalf of a Data Fiduciary and refers to Prudent Insurance Brokers Pvt Limited.
Applicability
This Privacy Policy is applicable to all users/visitors/viewers of the Portal. This statement and the Policy outlined herein are not intended to and do not create any contractual or financial or any other legal rights in favour of any User or viewer or any other party.
Please read this Privacy Policy carefully. By using any of the Services, You represent that You have read and understood the terms and conditions of usage, which includes this Privacy Policy, and You agree to be bound by all its terms.
Roles and Responsibilities
- Data Privacy Officer:
The Chief Information Security Officer is designated as the Authorised person for Privacy matters and for the purposes of implementation and administration of this Privacy Policy.
- Grievance redressal Officer:
The Compliance Officer is designated as the Grievance Redressal Officer of the Company for the purposes of redressal of any grievances/complaints arising with respect to this Privacy Policy.
Use/disclosure of your Personal Information and Sensitive Personal Data or Information
- The Personal Information and Sensitive Personal Data or Information collected from you may be used by us for a number of lawful purposes connected with our business operations and functions, which include but are not limited to:
- (i) Activities related to enrolling you to your organisation's Group Medical Insurance Policy and servicing the insurance policy;
- (ii) In the normal course of business to enforce the terms and conditions of products or
services or Terms and Conditions
- (iii) Dealing with requests, enquiries or complaints and other customer care related activities and all other general administrative and business purposes;
- (iv) Customer analytics on usage pattern and delivering customized content that may be relevant/of interest to you;
- (v) Performance of outsourced non-core activities as defined under the IRDAI guidelines;
- (vi) Sharing with reinsurers who may have offices located outside India
- (vii) Address network integrity and security issues;
- (viii) Carrying out any activity in connection with a legal, governmental or regulatory requirement, for the purpose of compliance of a legal obligation, in connection with legal proceedings, in connection with prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences, protect and defend our rights or property or act in an emergency to protect safety or to help investigations, monitor or prevent or take action regarding unlawful and illegal activities/suspected fraud/potential threat to the safety or security of any person;
- (ix) Carrying out activities connected with the running of our business such as
personnel training, quality control, network monitoring, testing and maintenance of computer and other systems and in connection with the transfer of any part of our business in respect of which you are a customer or a potential customer;
- (x) To create aggregated and anonymised data, we will use your personal information to create aggregated and anonymised information. Nobody can identify you from that information and we’ll use it to:
- make sure our services are working properly and continuously improve and develop our services for our customers;
- run management and corporate reporting, research and analytics, and to improve the business; and
- provide other organisations with aggregated and anonymous reports where required
- Disclosure of Personal Information and Sensitive Personal Data or Information
- (i) The Company is authorised to and may share Personal Information and/or Sensitive Personal Data or Information for providing you with any of your subscribed services and any service-related activities, and notifying or contacting you regarding any problem with, or the expiration of, such services.
- (ii) Towards this objective, the Company may be required to disclose your Personal Information to one or more Insurers, Third Party Administrators, Agents, Affiliates and/or contractors of Prudent and their sub-contractors subject to necessary non-disclosure agreements.
- (iii) In case you would like to withdraw your consent at any time and would not want us to process your information, you would have to register your request with your Human Resource (HR) function and upon receiving the instructions from them, we will stop processing your information. However, please note that we are a regulated entity and require to store processed data as per retention requirements prescribed by laws and regulations.
- (iv) The balance between privacy and investigatory powers is challenging. We share your personal information when the law says we have to, but we have strong oversight of what we do and get expert advice to make sure we’re doing the right thing to protect your right to privacy.
- (v) We’ll also share personal information about you where we have to legally share it with another person. That might be when a law says we have to share that information or because of a court order.
- (vi) In limited circumstances, we may also share your information with other public authorities. However, we would need to be satisfied that a request for information is lawful and proportionate (in other words, appropriate to the request).
- (vii) We will be required to share information with regulators like IRDAI when called upon and store all such collected information for a period as prescribed from time to time.
- The Company will store small text files called Cookies in your device in order to enable various features of our applications. These are used to keep you logged into the application, store user preferences and trends to improve user/viewer experience. You have the option to change your Browser settings to accept or not accept Cookies and depending on which you agree to our use of any information collected by us through that Cookie. Any such information collected will only be used for improving the Portal experience and will not be shared with any third parties/uninterested parties.
- IP addresses help us customise your visit to our Portal since they are tied to personally
identifiable information. We confirm that this information is not shared with third parties, for their promotional purposes, except as provided under Disclosure of Information clause. When you download or use our mobile apps, we also collect various device specific details like Device ID and Device Accounts including third-party accounts or MAC-address. This data is used to resolve technical difficulties and to provide you with the correct and most recent version of our mobile apps.
- When you download or use our mobile apps, we may receive and upload/share information such as your phone number, email ID, your location and your mobile device, including a unique identifier for your device with our analytics tools. We may use this information to provide you with the required support in terms of buying insurance products, use app-features, send timely reminders, push notifications, location-based services, search results, and other personalized content. Location services can be turned off using your mobile phone settings.
A detailed description about the same is given below:
- Approximate Location & Precise Location - This is used to identify the user's location to provide the nearest cashless hospitals and doctors available for consultation.
- Email Address - This app is using Email-IDs for sending email Communications related to the product purchases & other important information.
- Phone Number - This app is using Phone numbers for creating unique user IDs to avoid duplication, for sending policy related & other important information to the user.
- Files and docs - This is required to access and download the user's Policy documents and store in user's device.
- App interactions - This information is used to track the user activity within the App and share the activity data to App analytics tools.
- Device ID - Storing the Device ID to remove the creation of duplicate users and avoid any frauds.
- Audio, Photos & Videos - This app may require your Audio, Video or Photos to finish the claims process.
- Information, content and materials provided on any Portal are on an “As Is” basis and Prudent does not make any express or implied representation or warranty regarding the accuracy or completeness of the same.
Communication
Prudent retains the right to communicate with You (via e-mail, postal service / courier or mobile messaging services/app). Prudent further retains its right to communicate through third party vendors. You shall have the option to unsubscribe to receive such email communication.
Information security
Prudent takes reasonable precautions to protect the Portal and our Users information from
unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. We maintain information pertaining to you in our business records as per current regulatory requirements. Prudent shall retain your personal Information for as long as required to provide you with services or otherwise required under the law.
Permitted use
You are not permitted to use any Portal (including the mobile app and any webpage and/or data that passes through the web domain at prudentplus.in or whatsapp chatbot), its underlying programs (including application programming interfaces (“APIs”)), domain names, Uniform Resource Locators (“URLs”), databases, functions or its content other than for private, non-commercial purposes. Use of any automated system or software, whether operated by a third party or otherwise, to extract any data from any Portal for commercial purposes (“screen / data scraping”) is strictly prohibited.
Reservation of all rights to ensure permitted use and/or prevent unauthorised use
Prudent reserves the absolute right to take all actions it considers necessary against all parties howsoever involved in the unauthorised use of its Portal and without notice, in order to vindicate its rights and prevent such unauthorised use, including using blocking technology and/or issuing legal proceedings.
Changes to the Policy
The Chief Information Security Officer may amend or modify or novate this Privacy Policy at any time with approval of the CEO & Principal Officer. Notice of material changes to this Privacy Policy will be posted on the Portal where this policy is posted. Revised Privacy Policy/amendments thereto shall be effective from the date indicated therein. Users are requested to periodically check the terms and conditions under this Privacy Policy from time to time. Prudent shall not in any circumstance be held liable for such lapses on the part of the Users.
